Tax year 2025 · federal · general information

Is there no tax on tips now?

The deduction for tips, for tax years through 2028.

What it is

  • The Code allows a deduction for qualified tips. Tips are still income; the deduction reduces how much of them is taxed.
  • The tips must be on a statement you are given, such as your W-2 or a 1099, or reported by you on Form 4137.

Which tips count

  • Cash tips, which includes tips paid by card and, for an employee, tips received through tip sharing.
  • Only in a job where people customarily and regularly received tips on or before December 31, 2024.
  • The tip must be voluntary, not negotiated, and set by the customer. Tips received in a specified service trade or business, as the Code defines it in section 199A, do not count.

The limits

  • There is a yearly cap, and it shrinks as your modified adjusted gross income rises above a threshold set in the statute, which is higher on a joint return.
  • If you are self-employed, tips count only to the extent the business earns more than its expenses.
  • Your social security number has to be on your return. No deduction is allowed for tax years beginning after December 31, 2028.

What it turns on

  • whether your job customarily received tips on or before December 31, 2024
  • whether the tips are on a statement you are given or reported on Form 4137
  • your modified adjusted gross income
  • whether you work as an employee or for yourself

What would make it not apply

  • you are married and do not file a joint return
  • your social security number is not on the return
  • the amount was negotiated, required, or set by someone other than the customer
  • the business is a specified service trade or business
  • the tax year begins after December 31, 2028
